Law by God or Moses?

Matthew 19:4-6     And He answered and said, “Have you not read that He who created them from the beginning MADE THEM MALE AND FEMALE, 5 and said, ‘FOR THIS REASON A MAN SHALL LEAVE HIS FATHER AND MOTHER AND BE JOINED TO HIS WIFE, AND THE TWO SHALL BECOME ONE FLESH’? 6 “So they are no longer two, but one flesh. What therefore God has joined together, let no man separate.”

Matthew 19:7     They said to Him, “Why then did Moses command to GIVE HER A CERTIFICATE OF DIVORCE AND SEND her AWAY?”

Matthew 19:8-9     He said to them, “Because of your hardness of heart Moses permitted you to divorce your wives; but from the beginning it has not been this way. 9 “And I say to you, whoever divorces his wife, except for immorality, and marries another woman commits adultery.”

we see that any premarital sex or adultery on the part of the women except for rape meant she was stoned to death.

In Deuteronomy 24:1     “When a man takes a wife and marries her, and it happens that she finds no favor in his eyes because he has found some indecency in her, and he writes her a certificate of divorce and puts it in her hand and sends her out from his house,

You can read the rest of the context, but it is obvious that a means for divorce is already in place. Since adultery meant the woman would be stoned to death, unless the husband concealed it I suppose. So divorce was free for finding “no favor”. This can not be confused with adultery because adultery already has a seperate, specific and harsher resolution.

Wanted to get that out of the way to clear room for the main point. Jesus says in Matthew 19:8. “Because of your hardness of heart Moses permitted you to divorce your wives”. For some reason I believed it was God who allowed this and other freedoms because of the hardness of our hearts. Can we really look at Matthew 19 and not conclude divorce was a creation of Moses or of men ratified by Moses?

Here is the crux of the matter. What does that say about other rules in the Pentateuch except those which are specifically stated to be God’s commands? Scary stuff, but no reason not to consider simply because it’s tradition. Nothing has changed in my mind except on the allowance for divorce. But it will be on my mind in the future when I read the first 5 books of the Bible and see how they are interpreted in other books.
